Perhaps the business failed to create a cleaning schedule that would regularly remove spills from the floor. In that event, the "after-acquired evidence" of the employee's fraud can form the basis for a defense limiting the employer's liability for a possible "front pay" award, if the employer can establish that it would have terminated the employment, had it discovered the fraud. It is intuitive to think that the “market” will settle to some idea of business price equilibrium - something that the buyers will be willing to pay and the sellers willing to accept.

Manning comes flying out of the ring and lands on Bob and Susan seriously injuring them both. In doing so, we've created niche expertise in aviation disasters, product defect cases, medical malpractice, commercial vehicle and other catastrophic personal injury matters. Battery is a prime example of an act that is often both an intentional tort and a crime. The most basic relationship in our actual institution of tort law is the relationship between an injurer and his victim—not the relationship between each litigant, taken separately, and the goal of minimizing the sum of the costs of accidents and the costs of avoiding them.
